The judge was not very rational. He had a score to settle with MSFT. First he was pissed that they chose to ignore his Windows95 ruling only to later follow his court order. Of course that got overturned by Appeals. How dare they question his authority? How dare they make him look like a fool in the eyes of the appeals court judges!!

Then we have the Lessig appointment as some expert on the case. I believe Microsoft challenged that as well and won in appeals. No Lessig. Now he is even angrier.

This is how i will do it. I don't really want to made to look like a fool in appeals again. I hate those know-it-all appeals court judges. They think they are better than me.
Let me think--How shall i do this?
Finding of Fact is the key----rule against MSFT in a harsh manner so that they will be forced to settle. Then final victory is mine!! They will write about how i humbled the richest man in the world. I will be in textbooks everywhere.

So far so good.

There is a problem now. What if Microsoft actually takes it to appeals. The message to that level of court is clear. Jackson thinks you guys are idiots for overturning him on Windows95 and the Lessig appointment.

Now we are appeals court judges. Hmm. Jackson thinks he is so smart huh. He thinks that by making the finding of fact so iron clad that we won't be able to reverse his decision. Who does he think he is?
We will show him!!!!
There is the application of law that he is most vulnerable and of course we can always disagree with him on the facts of the case--we will find a way although we can't question him on his finding of credibility of the witnesses.
We have a score to settle with Jackson and that liberal DOJ.

My conclusion---we don't get a settlement unless the government backs off on harsh remedies. Of course Nukem has already indicated that they could appeal right after the verdict to ensure that no remedies are applied before final resolution. MSFT may or may not settle for PR reasons and launch of the W2K.

I wish i could be working for Microsoft---i just think they made too many mistakes and did not understand how to deal with public perception of the trial and the company. They are getting better.
