Some analysts noted Gemstar already has government approval to license the electronic program guide technology to other companies, making it less likely that the Justice Department will interfere.

``They allowed Gemstar to patent, so I don't see how they can use that as a merger blocker,'' said Janco Partners Inc. analyst Stacy Bingler Forbes, who has a ``buy'' rating. ``We still remain confident that this merger will close.''
