My understanding (translation: I'm too busy to look up the reference :-) is that there are parts of the system which are patented, and the rest are treated as trade secrets. Most important are some kind of purified bacteria or antibody samples. These are kept in two secure locations (to prevent destruction by fire) and are the heart of the rapid test kits. I sort of view it as the plates which the treasury uses to print money: there is no patent on the plates, they just have to be kept well away from other printers to avoid conterfeiting. In a sense, these samples allow NEOG to print money ;-)
