A popularity contest sounds like a great way to defeat the rule of law. If the company can defeat the rule of law, it can get its monopoly franchise back

I believe their unpopularity with the judge cost them a bad "finding of fact". They opposed the judge at every turn. He is now getting his revenge. If I hate MSFT, would i not be swayed by the anti-MSFT views than pro-MSFT. Facts can be blurred. Maybe the actual application of
the "rule of law" cannot.
