This would be a good deal for DEC. The board of directors should have forced the sale a long time ago. But who would want it? DEC was just beating it's head against a brick wall. I'm not sure whether it's such a good deal for INTC. A lot of the answer to this depends on the details of the likelihood of DEC winning the legal action. As outsiders we don't have access to this information.
The Alpha is a good microprocessor even if it is expensive to build. If Intel was able to market it better and thus increase volume the cost would go down, and they could probably use more fab space. Of course all this is a rumor so far. Almost anything would be better than the risks of a court case actually going to trial. Juries today are often picked for their ignorance. Anybody who might know enough to doubt "expert" witnesses are exluded.
