Because the judge is known to have lost to MSFT and been overturned on appeal in the past. He would not recuse himself from this case. He showed disdain for MSFT counsel during the proceedings in comparison to the DOJ counsel. Many believe that what should be impartial judgement has been clouded by his dislike if not outright hatred for MSFT based on past history. Finally, many have noted, to include writers that have no love affair with MSFT that it appears the judge practically signed off on what the DOJ did and filed it as FOF.

These are some of the possible reasons why some people have chosen to impugn the judge I would assume. They would have to answer the question for themselves in all fairness though.
