Why not??? It's proprietary to Sun and Sun hasn't been declared a monopoly by the FED and Sun hasn't been found to have engaged in price-fixing with their competitors.
MSFT is writing an O/S for a piece of hardware they don't own and is public domain. My contention is that this is reason enough for the PC O/S to be public domain as well.
MSFT could have avoided this situation had they not engaged in predatory business practices while holding a monopoly in PC O/S's for so many years. They could have spun off separate apps & O/S companies, they could have not sold apps, they could have donated their O/S to a standards body & still sold apps, they could have kept the O/S & the apps but published the source to the O/S & api's, thus giving non-licensed competitors in the apps market a fair shake, they could have gone out of their way to make sure there was no appearance of impropriety with such an obvious conflict-of-interest they had.
Instead, they got greedy and the predation actually got worse, and on a grander scale as time progressed. Now they are going to have to pay the price. Somehow, someway, they are going to pay, Duke. The only question left is "how much", not "if".
