Dave, I love TSC. I guess that's why I'm surprised Dave Kansas would let a piece like that run. If Kessler's trying to be clever, there's a fine line between clever and stupid. I don't know the legal definition of "recommendation to buy", but I'd argue that common sense says that when one writes that a reader should "just close your eyes and buy what you can" and then turns around and pulls a CYA disclaimer that says in effect, "um, back up there, where I used the word buy, please don't confuse that with an actual recommendation" IMHO the writer is flirting with "grin-f***ing weasal" territory. Herb Greenberg is the best financial journalist out there. Good trading, Tom
