I think it is more of a combination of trading and the way information was obtained. For example if you an officer of the company X that is about to buy company Y. You can not ask your relatives to buy stocks in a company Y. On another hand if someone tells you on a street that company Y is just about to be bought you will break no laws by buying company Y and profiting from it. In case of the fund managers it is even spelled out that they should use all of the available information that is obtained by legal means. And that includes insiders info.
