IMO, Thomas Penfield Jackson made it clear early on that he was pissed at Microsoft, and at that point the outcome of this case was a foregone conclusion. I've seeen more than my share of cases where the trial judge makes his or her mind up early on and if you're on the wrong side of that decision, all you can do is grit your teeth and ride it out. That's what Neukom and company are doing right now. This case is headed for the DC Court of Appeals, which has never been terribly sympathetic with broad antitrust remedies.

I had to laugh at an NPR story last night about how MSFT suffered setbacks yesterday when the judge denied MSFT's motions for more time and asking the court to reject the government's breakup remedy. MSFT never expected to win those motions. They're a set-up for the end game, which is the Court of Appeals.
