Just to be clear...

Losses claimed are limited to $3000 in excess of offsetting gains (long or short). Any additional loss would have to be carried forward into future tax years.

As previously stated, the only pertinent time limit associated with losses is the 31 day rule for re-buying a 'substantially similar' (read: the same) security.
