You've probably got brighter clients who would know that driving with hot coffee in hand is foolish in the first place. (unless the coffee is in a thermal mug that is self contained)

Was it the client or the attorney who thought up the scam?

I'm not sure it would have occurred to me to challenge the non-economics in that case based on the code section
