While no one in Congress has brought suit, 40+ members of Congress have filed an amicus brief in [yet another] Origination Clause case. This one filed in the 5th Circuit, which could be a different matter altogether from the one that went before the DC court.

And this is the real point in this issue. If the Origination Clause means ANYTHING it has to refer to this situation, as this is a fairly obvious violation, once you establish that the bill raised revenue. It raises not a little revenue, but a lot, and that revenue goes straight into the General Fund for Congress to spend as it sees fit.

They say the smart money is betting against this issue, but it seems to me the Court will have a difficult time explaining what the Origination Clause DOES mean if it doesn't mean THIS.
