It sounds like a tax and spending clause problem, but I haven't looked into this one too much. It's pretty well settled, though I don't like it, that Congress can put whatever strings it wants on spending grants to the states under federal programs, so long as the string has some connection with the program. Open, shut. The state wants federal money? Then Congress can say take the money so long as it complies with our definition of marriage for distribution of the money.
