Foreigners can stake claims on BLM land. I am not sure of the mechanism, (US subsidiary, partners, etc.) but it happens all of the time. Placer and lode claims can be staked on the same claim. Placer only covers loose dirt and lode covers hard rock. Disputes can arise and have. It is usually up to the government, mineral examiners and judges to resolve differences.
