"I could have sworn that Apple brought a patent infringemt i.e. stolen technology case against MSFT and it was summarily dismissed. So the stolen technology argument doesn't carry much water. It's not a bad deal for Apple but it is far from being the solution to all their problems which is what some industry analysts are trying to point out to the jeers of the Apple faithful. I do agree though, I can't wait for the next couple of years to watch the desktop -vs- network computing war."

Even though in legal terms Apple lost the patent infringement suit, I think it is safe to say that Microsoft copied the Mac OS in Windows. The common man on the street would agree. I don't think anyone is saying that this deal solves all of Apple's problems, it's just a step in the right direction. Even after the dramatic rise in Apple stock over the past few days, Apple is still only valued at about $3 billion. This isn't the end of good news for Apple though.

* The clones will eventually cave in to Apple's modest demands, if they don't, they will collapse.
* It seems more and more likely that Apple will post a profit in the 4th quarter.
* With this new computer-literate board, Apple seems poised to get the right world-class CEO.
* They are changing their distribution strategy, selling direct now (in addition to existing channels).
* More great board members will be named.
* Rhapsody is progressing well and it seems that it will do AT LEAST as well as Mac OS 8. It is a direct attack on Sun.
* Apple's products will continue to improve and they will simplify their product line.
* And the chance factor...

In sum, whatever Apple stock does in the short term I'm not concerned about. I won't begin to think about selling until late 1998.
