Maurice, that's pretty much the way the bankruptcy law works. You can continue running your company in bankruptcy, even if the world knows you are both stupid and corrupt. There are many, many examples. The bankruptcy court is not the place to improve management quality but exists simply to find a way to get rid of distressed assets. And as far as finding an equitable solution to a company with financial problems, most judges couldn't care less.
