Excerpts from a recent MStanley assessment on the case:
-The market realizes that due to the claim structure it is likely that the industry may lose the first phase.
-First phase loss cannot result in any financial award. The industry will not face the threat of a single massive damage verdict. At worst, the trial would break-down in a series of individual trials.
-A six person jury will decide and the verdict must be unanimous.
-The jury is likely to rule on three issues a) can smoking cause diseases, b) are cigarettes addictive, c) are punitive damages appropriate.
-Judge Kaye has yet to announce exactly what the jury will determine. The precise wording of the questions presented to the jury will be critical. (Theo, you may want to follow up on this)
-Given the length of the trial, phase one jury deliberations could last 2-4 weeks.
