Well, I wasn't just talking about sloppy, as you seem to be; I was also talking about discriminatory and corrupt.

Corrupt would be similar to sloppy except that it would be intentionally wrong rather then accidentally wrong so it would be worse. Sloppiness or corruption can get innocent people convicted. I would agree with you about corruption as well with the possible exception of agreeing about how often corruption is a factor.

Discriminatory is not as big of problem for me as long as it does not extend to wrongful conviction, and if it does extent that far it would be the wrongful conviction that was the problem, not the disparate impact on different races.

If in a state over a particular time 30 murders where committed 20 by white people and 10 by black people (for simplicities sake I am ignoring other races in this scenario) and all of the murderers where caught charged and convicted, and 8 of the guilty white people where executed while 9 of the guilty black people where executed, I would not have too much problem with this. I would only have a big problem with this if I was convinced that the death penalty was inherently unjust in which case it would not be the racial stats that bothered me but the unjust punishment. If the punishment is just then each individual was not treated unjustly and I care about people as individuals not as a member of some racial group.

What I would have a problem with is if an innocent person, white or black, where executed.
