Statement on Breakdown of Settlement Talks in the
Microsoft Antitrust Case

WASHINGTON, April 2 /PRNewswire/ -- Statement on the breakdown of settlement talks
by Association for Competitive Technology President, Jonathan Zuck.

``This is a sad day for the computer industry and for technology users. Reports of a serious settlement offer by Microsoft went
above and beyond what any judge would have granted. However, because there was obvious dissension in the ranks between
the DOJ and the State Attorneys General mediation has broken down. This dissension is a perfect example of what happens
when the government gets involved with the high tech industry.

``It's unfortunate that an outspoken minority of AGs is holding the industry hostage by derailing settlement talks at a time when
resolution seemed possible and industry competition is rampant.

``Clearly these militant AGs are torpedoing the industry to further their extreme political interests. They need a judge's ruling to
open the door for class action lawsuits, which is the real goal here.'

ACT is a national education and advocacy group for the technology industry. ACT's membership includes businesses and
professionals in computer software and hardware development, and consulting, training and Internet services businesses. ACT
is dedicated to preserving the role of technology companies in shaping the future of the industry.

ACT President Jonathan Zuck is available for commentary and analysis as this phase of the Department of Justice's suit against
Microsoft approaches Judge Jackson's release of his Conclusions of Law.
