That really doesn't make a lot of sense. There is little difference between the current response by government, and a libertarian response. Currently "They'd likely get off because of those "entertainment only" weasel words." Under a libertarian regime - "They'd likely get off because of those "entertainment only" weasel words."

A libertarian regime would still be against outright fraud.

Ethically? They're frauds.

Ethically they take advantage of people, but I'm not sure I'd call them frauds. "entertainment only", may be "weasel words", but they amount to a direct statement that the line is only for entertainment.

If I ask you "Can I have two 10s for a 5", and you not thinking actually make the exchange. I don't think you either can, or should be able to charge me with fraud. In some ways these 1-900 lines, and casinos or lotteries for that matter, are similar.
