David,
One submits the form for Rule 144 exclusion in order to sell unregistered (restricted) stock, the individual need not be an insider (wouldn't be if, eg, he obtained less than 5% of the outstanding stock in a private placement)--I assumed that Jobs stock was the result of converting NExt options.
