I think the courts are looking back to judge the future. By the time the appeals reaches the Supreme Court the political and new world culture may be so different that it may seem trite to punish MSFT for that little desktop thing.

Case/McNealy are using the courts and DOJ to do on the internet what MSFT has done on the desktop -gain an unfair advantage on the initial swing. Except MSFT did it by shrewd innovation -much more acceptable than using the people's government! This should be MSFT's trump (or get out of jail) card going forward. And they are playing it to the general public right now. IMO.

Do not underestimate the power of the modern day monopoly!
