Unlike a real foreign import tariff run by executive action, wouldn't this "spending tariff" have to be imposed first by legislation? That's where it could run into an issue to get started.

It takes politics out of the equation for the most part, if it is applied equally across programs. Maybe it could get passed?

I've often wondered about the crazy incentive to spend every last penny on wasteful things at the tail end of the fiscal year. The people who didn't waste in their programs and returned money to the treasury get docked in future years, simply for being efficient. The wasters got rewarded because "think of all the things they could have done if they had even MORE to spend next fiscal year."
