I don't think anybody has accused Microsoft of a crime. If they had, we'd be talking about "beyond a reasonable doubt."

What do you mean? Your favorite judge found Microsoft guilty of a crime, violating anti-trust laws. Since the punishment can be much greater than a fine of $10,000 (or is the limit $1,000?) then the violation would be defined as a felony if it were a law applied to a natural person.

And all because they took legal actions that became illegal when their market share hit some Magic Number that can only be determined in retrospect.
