GOVERNMENT'S OPPOSITION TO DEFENDANT STANLEY’S MOTIONS TO DISMISS FOR DUPLICITY (Doc. 88)
The United States of America, by and through its counsel, Sally Quillian Yates, Acting United States Attorney, Northern District of Georgia, and Justin S. Anand, Assistant United States Attorney, hereby submits this Opposition to Defendant Stanley’s Motion to Dismiss for Duplicity, as follows:
Subsequent to the pretrial conference, Defendant Stanley moved to and was permitted to adopt Defendant Harris’s motion to dismiss for duplicity (Doc. 69). The United States responded in opposition to Defendant Harris’s motion to dismiss on February 23, 2010 (Doc. 87). The United States neglected to clarify that this response was also in response to Defendant Stanley’s motion (Doc. 88). Indeed, Defendant Stanley raises no arguments separately from Defendant Harris’s motion. Thus, by definition, Defendant Stanley’s motion fails for the same reasons as Defendant Harris’s.
Therefore, pursuant to the Court’s scheduling order, the United States submits this memorandum, which refers to and incorporates the United States’s prior response (Doc. 87), in opposition to Defendant Stanley’s adopted motion to dismiss.
