Andy: Great Post ! With respect to Linux it is just another IX in fact a misspelled IX and although the entry cost is low it would appear that overall costs might be deceivingly high compared to W2K unless the DOJ thwarts MSFT in the full implementation of the W2K grand plan which no doubt McNealy et al are counting on.

Concerning the gray area. It seems that this might have been addressed when the copy machine came into full with regard to books and sheet music etc. I do not see why those precedents don't apply in these cases as it is just a matter of scale. It would seem clear that if Napster et al. make no commercial profit direct or indirect from their site then the laws governing xerographic reproduction of copyrighted material would and should apply.
