They did. He was convicted.

The question is why didn't he get an appropriate sentence. Many people who hold TS clearances believe it was a travesty of justice.

One can only speculate about why a more stringent sentence was given, but a reasonable speculation is that Berger's attorney's threatened that a trial would require the disclosure of TS information and DOJ concluded it would be better to just let it drop with a slap on the wrist.
