I have no idea. IMHO, MS should have settled prior to the suit being filed. MS's bargaining position has steadily deteriorated as the trial has progressed. It can't improve significantly until oral argument on the appeal. That will be the first opportunity for both sides to evaluate how the appellate court views Judge Jackson's decision. (All of this is, of course, dependent upon Jackson following his expressed intent to split-up MS.)

The other event which could move the case to settlement would be the election of Bush and a concurrent signal from Bush to DOJ that further efforts on the part of this administration to split MS will not succeed for lack of time to complete the job. That could move the DOJ to seek a favorable settlement which avoids the death penalty for MS.
