Court rejects Applied Materials motion vs Axcelis
BEVERLY, Mass., April 26 (Reuters) - Semiconductor equipment manufacturer Axcelis Technologies Inc. (NasdaqNM:ACLS - news) on Thursday said a court rejected a motion filed against it by rival Applied Materials Inc. (NasdaqNM:AMAT - news)

Axcelis said the U.S. District Court in Massachusetts rejected the motion filed by Applied Materials, which sought to dismiss three of the four claims Axcelis brought against it involving tortious interference and unfair competition.

Axcelis said Applied did not challenge its central claim of patent infringement, however.

The United States Patent Office had ruled in favor of Axcelis two times before to uphold the validity of a patent for the use of radio frequency linear accelerator technology in high-energy ion implantation. Applied Materials allegedly sought to conceal that it was the anonymous entity that twice challenged the validity of the patent.

Shares of Axcelis gained 11 cents to $14.71 in Thursday midday trade on Nasdaq, while Applied Material's stock fell $1.62, or 3.1 percent, to $51.56.
