We need to get past the preliminary injunction hearing on Friday up in S.F. Don't assume that the injunction will be made permanent. The good news is that Nomai has conceded that its disks do not work in all configurations of Zip (i.e. laptops) and therefore they can not and will not be allowed to claim that the disks are 100% compatible even if the injunction is lifted in some way. If the injunction is lifted (pending trial on the patents, of course), the key may well be the wording Nomai is allowed to use. Will they be allowed to say: "For use in the following Zip drives" (and then give a list of drives)? Or will they not be allowed to use the word "Zip" (which implies some sort of Iomega approval) and have to use words like: "For 100 MB drives" in a more generic sense. Who knows. I do know that IOM continues to argue that the Nomai disks (even the newer ones) can damage Zip drives and that Nomai shouldn't be allowed to sell these disks- period.
