Having lunch with Hogan has nothing to do with the merits, as Hogan won't want to hear the merits ex parte, even if there is no indictment.

I don't do criminal law at all, but it seems to me that meeting with the Judge ex parte in the context of a grand jury proceeding in which there are technically no opposing parties is probably fine ethically. I would therefore not necessarily conclude that only administrative stuff took place, though obviously that kind of discussion may well have taken place.

I think there is a definite chance he'll seek an extension.
