Welcome to a system of justice run by people, whose morality, ethics and behavior, as an entire powerful subculture within our society, are centered by "the truth that defines how we act is what was decided by the last case."
A problem, beyond the moral and ethical vacuum that we all rail against in our jokes about attorneys, and the fact that we have to put up with justice system in which there is little justice, is that it is not going to change until it is no longer run by Judges who attend to these same professional principles.
So, the fox is guarding the chicken coop, and they are our chickens. No wonder there isn't enough nourishment (justice) to go around.
Now, I know that there are good people who are judges and attorneys. This is not a black and white diatribe against all involved with the law. It is a statement of a problem and what is driving the problem.
The problem of a legal system not serving us well, and continuously going more and more out of control, as evidenced by the general popluation's love of the system and those that practice within it, must become a topic of general discussion. Better, the discussion must lead to the Justice system understanding that it is failing and that it needs to become self policing around some Solomon like principles.
Best,
