It is my impression that the recent agreement between Microsoft and the DOJ to allow OEMs to delete the explorer icon from the Desktop is a temporary agreement, to last only as part of a temporary injunction, up to the final judgment by the Court of first instance. The injunction itself is under appeal. I would appreciate it if someone would confirm or contradict this impression. If my impression is correct the DOJ has extracted less thasn an ounce of flesh inasmuch as the OEMs will not delete the icon in any event. In return the DOJ will not be imposing a million dollar a day penalty. I think MSFT as usual has made a great deal. The Media has conveyed the opposite opinion.
