Yes it does seem really confusing !
But what your post really brings out is the sad lengths that some posters will go to in order to wreak havock on people and corporations. Creating false aliases, hiding behind false names, obtaining and using other peoples credit cards, using PO Boxes for home addresses to avoid being found, assuming other peoples names and addresses, using other peoples Email addresses, using other peoples PC's, using the John Doe name, it goes on and on. What these and other similar posters are not taking into account is that there is a solution to all these schemes, and working within the legal system, no-one can get away with it in the long term. Judges / Courts are leaning heavily on the side of the plaintiff in such cases brought before them.
What is also important to note, is that once a poster gets served with a subpeona or a deposition or any other court documents, the system becomes very overpowering. One is subject to having to search and find all old documents and records, make copies, get old emails, faxes, letters, telephone call detail records, sit in depositions and explain what you did, why you did it, and have it all recorded by a court appointed recorder.
Then the possibilities of being caught out as a liar, perjury, contempt, sanctions, fines, wow ! what a hassle.
There is definetely a second side to having fun "Bashing"
Finally, a judgement. What does that mean ?, it means that the plaintiff winning an award gets the power of the American Judicial System, to enforce the courts judgement, attach your assets, your business, your belongings, your money, your car, even your home and sometimes even your future salary taken straight out of the paycheck.
At the end of the day, think about it, it just can't be worth it !
Posting fair critisism, doing due diligence, even stating differences of opinions are not only legal, but welcome. Outright lying, libel, slander, false allegations, harrassment, and viscious and malicious innuendos are not.
