I believe they've said something like "if drive manufacturers want to use km in 97 they believe, based on time to get product to market, that an agreement would have to be reached before end of year." Also, in their 2Q mailout brochure to shareholders, they mentioned that "with their current degree of FOCUS on KM, something (yea or nay) should be known before the end of the year"
They are just trying to guess what drive manufacturers would most probably do given their time frames for production.
