This tack has been tried already. Apparently there are a number of cases where people have been prosecuted for perjury in a federal civil case that is under appeal. It is a crime, and it is prosecuted. These cases were brought to light when the Clinton supporters tried to claim that this was selective prosecution - that no one had ever been tried for perjury in relation to a civil suit.
