There was an article this weekend in the Financial Post (Toronto) on
BioChem Pharma trying to explain the law suit from Emory University.
From what I understand of the article, BioChem has the patent for the
end result 3TC but neglected to patent the ingredient drugs. Emory
can thus make the drugs going into 3TC but can't make the drug itself.
It sounds very strange, but the article goes on to say they expect an
out of court settlement from BioChem who is flush with cash from a secondary offering. I have a dozen news releases in my email trash from Biochem, I'll go back and reread them and see if I can't add anything further.
