I think Jackson would be improper if it were a judicial case, but since he is the judge and jury in this case his bias is consistent with his role.

Your comment about AAPL and SUNW being 3-5X more for essentially the same thing is weak in some respects because AAPL and SUNW are finding lots of customers for their products, so they must not be the same. The promise of Wintel offering comparable functionality for a lot less money remains, but the cost benefit is not enough for the masses to move to the Wintel platform... yet.

Once Wintel gets it together and starts selling into the booming internet/enterprise server market and competing with SUNW and ORCL head-on, it will get interesting. Especially since SUNW and ORCL seemed to have played their very last card- "protect me because I am being wronged"- first. SUNW and ORCL may find themselves like AAPL as the high end server market matures further- relatively expensive and proprietary. Looking back Wintel replaced a lot of IBM mainframe stuff with Windows 3.1 and Novell at the server. Then they took Novell share with NT. Once Datacenter matures....

My argument assumes that Microsoft will come out of this vindicated.

In my opinion.
