The justice dept has been lax/tolerant, as his monopoly on went naturally to a virtual lock on the desktop, as he was only making a product, and others could buy XYZ. Apple decided years ago to go on a downtrend(by that I mean the course was chosen by Apple executives to lead on to glory,profit and an Apple monopoly, but the law of unintended consequences came into effect, and the market adapted around Apple, and the executives stayed dumb, and got even dumber) and so that is not Gates fault. However if Gates takes the step to buy Apple, they will step in hard. They may not want any connection between Apple and MSFT to exist, and that is why the restrictions were put on the paper MSFT bought, as a palliative to the dept of justice.
The only way for Apple to survive is "clones etc etc"
