<font size=4>DITHERING OVER DOCUMENTS

<font size=3>NY Post

September 18, 2004 -- <font size=4>One of the most notoriously left-wing judges on the federal bench has ordered the Pentagon to release by next week any unreleased files related to President Bush's Vietnam-era service in the Air National Guard.

The ruling by Judge Harold Baer — who sparked national outrage a few years ago when he overturned the conviction of a drug mule caught with $4 million in cash and cocaine, saying minorities are right to automatically fear cops — came in response to a Freedom of Information Act request from The Associated Press.

Meanwhile, the legal watchdog group Judicial Watch made a similar request for unreleased files about John Kerry's military service.

It was told by the U.S. Navy that 31 pages of documents remain closed to public inspection.

Why?

Because under the law, the documents can't be disclosed without John Kerry's authorization.

And John Kerry refuses to grant that authorization.

Even though he and his aides repeatedly have suggested that all his records are public and available on the campaign Web site.

And even though Kerry's commanding officer at the time charged last spring that the Massachusetts senator essentially awarded himself a Purple Heart after receiving a superficial scratch.

Three Purple Hearts, recall, meant an automatic early exit from the battle zone — which Kerry asked for and got, so that he could return to the United States and publicly denounce U.S. troops in Vietnam as rapists and butchers.

The question of who did what 30-plus years ago should never have gotten the kind of prominence it has in this debate; other issues are far more pressing.

Nonetheless, Kerry supporters and the press gave the candidates' military records — or the president's record, anyway — new attention when Bush's lead in the polls soared, thanks to a successful GOP convention and the surprising effectiveness of those Swift boat veterans ads.

So it was hardly surprising that the president's National Guard record suddenly re-emerged in the national media.

But if Americans are going to see a release of documents, they should see a release of all documents.

Not just those about George Bush and the Guard, but also those still-secret 31 pages, and especially the medical records on John Kerry's Purple Hearts.
