But if she meant to kill the child, and acted with intent to do that, it is murder.

I suspect the defense will plea-bargain it down, and the prosecutor will probably agree. But he starts at murder to get the best plea bargaining position to start from.

Or the defense may go to trial on a diminished capacity charge, or a temporary insanity charge, though those are risky defenses.
