Hard to say what the rally today was related to but it has looked like Apple had been oversold and looks much cheaper on a fundamental basis.

"Even a moron in a hurry could not be mistaken about that," the distinction between the computer company's iTunes online music business and a recording company like Apple Corps Ltd., Apple Computer attorney Anthony Grabiner said.

Grabiner said the "distribution of digital entertainment content" was permitted at Apple Computer under the agreement.

"Data transmission is within our field of use," he said. "That's what (the agreement) says and it is inescapable."

All these statements are pretty strong, and make me think that the Apple Corps lawsuit is no big deal.

hmcourts-service.gov.uk Based on this, it seems the main argument has to do with the context of the use of the apple logo more than anything else. I'm not a laywer, but based on my reading, Apple Computer is perfectly within their rights.

Combined with the other European problem (France IP law) also being a non-issue, Apple's future in Europe looks much brighter than a week ago. In 3 months, both these issues should be resolved and help other positive factors develop further momemtum to the upside(new products announced at 30th aniversary?).
