In all fairness, I'd guess they fully intend to hand over the information, but are waiting for the subpoena for two reasons. First, they get to look to their readers like they're standing up for free speech, privacy, etc. against the attempted encroachment of Big Brother. Second, and probably the primary reason, they get to avoid getting sued, however ridiculously, for violating the privacy of posters on their website. In other words, they are waiting for the subpoena because their lawyer said that's the legally safest route. Oh, and they'll get more movement brownie points from their fans when they put out a whiney PR about how they regretfully had no choice but to comply with Big Brother and hand over the dopes' names.
