It was his own fault. He was carrying a gun with a chambered round. This is ok for a cop or a soldier, who might realistically be called on to shoot on a moment's notice, but not the mall shopper.

The mall shopper should carry a loaded gun without a chambered round. He's likely to have the extra second it takes to rack the slide, if he ever needs to shoot anyone in his life, which is unlikely.
