I can't imagine how the "regulators" could justify calling CMGI a Mutual Fund. Most of CMGI's holdings are private -- not tradeable by an individual. Why isn't Berkshire Hathaway regulated as a Mutual Fund? Leave it to the government or regulators to be unable to leave a good, private investment alone... They see some success and worry "we can't have this going on without getting our slice of the pie!"
