One issue seems to be whether the Writ of Habeas Corpus applies to non-US citizens for whom even certain non-criminal activities may subject them to deportation proceedings.

Although I do not follow these matters in detail, I believe that new anti-terrorism legislation even compromises habeas corpus for US citizens.

Sorry I can not be more helpful, but I practice neither criminal nor immigration law.
