This has been talked about in the legal press for some time. The theory is the same basic theory as finally prevailed in tobacco litigation.

As in the tobacco cases, the first cases here are likely to be lost, but the crusaders behind them are in it for the long term, and will be satisfied if in 10 or 15 years they get the same sort of capitulation they got from the tobacco industry. Meanwhile, they will sop up enormous amounts of judicial and corporate resources.
