If murder were to be treated equally, period, there would be only one degree of murder, with one possible sentence. Yes?

Why should the person who kills from passion be able to be charged with second-degree murder, while a person who murders during the commission of a felony be charged with first-degree murder? The victims are being treated differently in those instances.

Or is the connection I'm making to the argument strained?
