Mr. Wack, After making several attempts to reach you and other NXLC officials to discuss material facts which would be able to be discussed by the general investing public, let alone securities analysts such as myself, I became concerned about the validity of the company press releases, position against the FCC and your business model in general. I can see by the markets reaction to your settlement that it was unfavorable to shareholders, but a far more reaching blotch on the record of all at NXLC who claimed to be pursuing something they had no intention of achieving. It now appears that this whole transaction was nothing more than a way to enhance the financial wealth of a select few. Although this attitude seems to be prevalent amongst the legal profession as well as anyone on Wall Street these days, I was under the impression of a sincere desire to promote the wireless industry to a higher standard by implementing a sophisticated technology. Had I known your true resolve, I would have never made the recommendation to support your cause, let alone make block purchases of your stock. Alas, there is a larger implication of one that hurts the general public by hindering the evolution of a technology that could enrich the lives of many users by surrendering spectrum to those that would limit the progress of said evolution. The additional delays of the inevitable success of CDMA, and all its' forms, for future voice/data delivery will be mild, even in the face of the greed of a small group such as yourselves. Again, your companies actions are in direct contrast to that which you would have me believe and for that I'm disappointed. For hurting the American public I'm appalled.
